Particulars of its organisation, functions and duties

The vigilance set up in NABARD consists of a Central Vigilance Cell (CVC) at Head Office (HO) and Vigilance Cell at Regional Offices (ROs) & Training Establishments (TEs) functioning under the overall control of the Chief Vigilance Officer. The CVC of the Bank has accepted the jurisdiction of Central Vigilance Commission, GoI.

The important functions of the CVC include dealing with matters concerning vigilance cases against staff on the basis of complaints received from Public including own staff, Governments & Central Vigilance Commission, GoI, receiving returns from the Regional Vigilance Cells and furnishing returns to Reserve Bank of India, Central Bureau of Investigation, Central Vigilance Commission and GoI.
It also keeps liaison with the above named agencies. CVC at HO conducts periodical Preventive Vigilance Inspections (PVI) of ROs, TEs and also HO departments as directed by CVO/MD/Chairman.

The powers and duties of its officers and employees

The Chief Vigilance Officer has such powers and duties in vigilance matters vis-a-vis the employees of NABARD as are exercised by the Central Vigilance Commissioner, GoI in respect of the public servants within the latter’s jurisdiction. The Vigilance Cell in each RO/TE is headed by Officer-in-charge of the concerned RO/TE. The Central Vigilance Cell deals with the cases pertaining to all the employees attached to its Head Office and of officers in Grade ‘D’ & above attached to ROs & TEs. The Vigilance Cell at ROs & TEs attends to vigilance cases pertaining to non- officers staff and officers in Grade ‘A’, ‘B’ & ‘C’ attached to their  establishments, subject to such general/specific instructions issued by Central Vigilance Cell, Head Office from time to time.

Procedure followed in the decision making process, including channels of supervision and accountability

The decision making process followed in the Cell is as per the procedures prescribed under NABARD (Staff) Rules, 1982 and guidelines / instructions issued  by Central Vigilance Commission, GoI from time to time. A clear cut demarcation of roles, responsibilities and discretionary powers exists accordingly.

Norms set by it for the discharge of its functions

The complaint or an allegations against an employee having vigilance angle is investigated in accordance with the procedure laid down for conducting disciplinary proceedings. Cases of officers in Grade ‘D’ & above are referred to the Central Vigilance Commission for first stage advice (before instituting   disciplinary proceedings) and  second stage advice (before imposing penalty). Normally, enquiry is conducted by an officer of NABARD. If, however, NABARD considers that the enquiry should be conducted by the Commissioner for Departmental Enquiries, it requests the Central Vigilance Commission to nominate a suitable officer for  Departmental Enquiry.

Rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions.

  2. Acquisition / Disposal of Immovable Property and Movable Property guidelines
  3. Preparation of Agreed List and List of officers of doubtful integrity
  4. Instructions on Tenders

A statement of the categories of documents that are held by it or under its control

i) Manual, instructions & office notings relating to vigilance cases.
ii) Annual returns of Immovable Property (held as on 31 December) and Statement of holding of shares/debenture / bonds/securities, etc. (held as on 31 March)  received from the officers staff.
iii) Report on Preventive Vigilance Inspection of ROs/TEs and HO Depts.
iv) Correspondence relating to permission for acquisition /disposal of immovable properties and transactions in movable assets exceeding Rs. Rs. 50000/- in respect of the officers staff.
v) Agreed list and list of officers of Doubtful Integrity.
vi) Monthly return on award of tenders/contracts  exceeding Rs. 10.00 lakh received from ROs/TEs and HO Depts.
vii) Quarterly/Annual Statistical Returns/Report regarding activities of the Vigilance Cell at ROs/TEs.
viii) Returns/reports submitted to RBI and Central Vigilance Commission, GoI.

Since Cell deals with the vigilance matters of confidential nature pertaining to the employees of NABARD, there is no arrangement of consultation with the public.
