Function and Duties:
The Law Department manages the legal affairs of NABARD and its subsidiaries which include:
  • Tendering legal advice in Policy and operational matters referred by the management and various operational departments of HO/ROs/TEs/Associates of the NABARD and also to GoI more particularly in areas relating to staff matters, vigilance matters, disciplinary proceedings, long term and short term credit, infrastructure lending, resource mobilization, premises matters, RRBs and Co-operatives. The work involves interpretation of NABARD Act 1981 and the rules and regulations governing the NABARD staff, Constitution of India, Administrative Law, Banking Regulation Act, 1949, the Reserve Bank of India Act, 1934, Industrial Disputes Act, 1947, various State Co-operative Societies Act, Multi State Co-operative Societies Act, 2010, Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, Recovery of Debts due to Banks and Financial Institutions Act, 1993 and various other central and state statutes.
  • Drafting of amendment of NABARD Act,1981 and the rules and regulations. Also associated with legislative drafting as well as amendments to existing legislation and subordinate legislation such as rules, regulations, etc. for Co-operative Banks and RRBs and vetting of draft legislations to be placed in Parliament/State Legislature and examination of its validity, which are concerned with agriculture and rural development referred by GoI and State Governments.
  • Appearing for NABARD in Conciliation Proceedings, BIFR proceedings, Consumer Forum, Tax matters and Arbitration hearings.
  • Litigation Management which comprises preparation of instruction to counsel appearing in Courts on behalf of the NABARD and preparation of pleadings before Courts and Tribunals and liaising with the NABARD and its Advocates.
  • Documentation of various Facility Agreements like Co-finance, refinance and infrastructure lending agreements, security documents and Restructuring Agreements and other documents sent by various operational departments and Regional Office and Associates. Vetting of policy documents of NABARD including policy in respect of staff, OTS policy, Recovery Policy, etc., and of internal and external circulars of the NABARD pertaining to lending procedure, invocation of guarantee and enforcement of securities
  • Legal matters with regard to acquisition of premises for the bank including title investigation, pre-agreement exercise, documentation, tendering legal advice and participation in Arbitration and Alternate Dispute Resolution Procedures.
  • Participating in negotiations on behalf of the NABARD where legal issues are involved.
  • To be part of Expert Committee / Working groups constituted for matters dealing with the various operational and policy matters of the NABARD and also Committees constituted by Central Government and RBI in respect of agricultural laws, banking laws and regulation of RRBs and Co-operative Banks.

The powers and duties of its officers and employees
  • Legal Services have been constituted under NABARD (Staff) Rules. The Bank has recruited legal professionals practicing in Courts as Advocates or who have work experience in Law Departments of Banks/FIs.
  • Law Department basically provides in-house legal consultancy to the Bank. It manages legal affairs of the Bank.
  • It works in close cohesion with various Operational Departments and Regional Offices/Sub-offices/Training Establishments and tenders legal advice and provide related services.
  • Aids management in decision making in the light of legal position.
(iii)
Procedure followed in the decision making process, including channels of supervision and accountability The Department is headed by a Chief General Manager who is assisted by a team of four Assistant General Managers and Ten Managers. The department functions under the overall guidance and supervision of the CGM assisted by AGM. AGMs are in turn assisted by the Managers in discharge of their work.
(iv)
Norms set by it for the discharge of its functions Functions are discharged within the framework of law, relevant acts, rules and regulations as prescribed under the law from time to time.
(v)
Rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions Law Department has a library containing various books, journals and periodicals which are accessed by the staffs for disposing the cases and advising the legal issues.
(vi)
A statement of the categories of documents that are held by it or under its control. Law Department tender legal advice on various matters referred by the operational /offices/subsidiary of NABARD.
(vii)
Particulars of any arrangement that exists for consultation with or representation by the members of the public in relation to the formulation of its policy or implementation thereof.
(viii)
A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.
